Hello Citizens of Black Rock City,

This newsletter is a long one - lots of legal, technical and government information.  Please review careful, to make sure all of your i's are crossed and your t's are dotted.

The Placement Team are still aglow from our first big mapping weekend!  It takes our little team all month to piece together this fine city.  Thanks to everyone who indicated neighbourhood flexibility.  That helps immensely with the highly detailed planning we do.

We will announce Placement in Early July.

Just to prepare you, we will not be able to place every camp who completed a questionnaire.  This is the toughest part of our job, telling people they will not be on the map.  However, please know that we are in no way saying you are not a Theme Camp.  We invite everyone to bring your ideas and visions to the Playa and create magic in every part of Black Rock City - not just in the designated Theme Camp areas.  Burning Man is for spontaneity and marvelous interactions, wherever we are.

2 Fundraising and Intellectual Property

Greetings Burning Artists and Theme Campers!

 

Fundraising season is underway – so what better time for a refresher on Burning Man's Intellectual Property use (aka "IP") policies?

BUT FIRST A WORD ON WHY:

As a participant of Burning Man, you know well the importance of the guiding Ten Principles to the culture of the community in Black Rock City and beyond. Apart from admission tickets and ice and Center Camp CafĂ© beverage sales, there is no commerce, advertising or sponsorship at the Burning Man event. It is this freedom from commodification that, along with the other Principles, enable and encourage the community to build and gift the energy, experiences, art and freely-given services to other participants, making Black Rock City so wonderful and amazing. 

At the same time, we know some of you may have questions. Here is a detailed description of how to proceed safely this event season to incorporate our culture's trademarks, expressions and images in your art and gifts, carrying the freak gifting-flag flying high:

This summary will cover:

 

  1. Gifting of items containing Burning Man's Trademarks, Copyrights or Images
  2. Use of the words "Burning Man" or "Black Rock City"
  3. Use of Photographs taken at the Burning Man Event

 

 

1. Gifting of Items containing Burning Man's Trademarks or Copyrights or Images from BRC 

The Man symbol, logo and structure, and the Black Rock City map, are protected copyrights.  The terms "Burning Man," "Black Rock City," "Decompression," "Precompression," "Recompression, "Burnal Equinox" and "Flambe Lounge" are protected by trademarks.  This intellectual property is protected from unauthorized use by third parties, but the Burner community is encouraged to incorporate and use the trademarks or copyrights, or photos obtained at Burning Man, in artwork and gift materials along the following guidelines.  

 

Totally OK: GIFTING

 

Items that incorporate the Man symbol, other Burning Man trademarks or copyrights, or images obtained at the event into a design can be gifted as a thank you, a note of appreciation or recognition, or as a reward in return for some achievement, contribution or lampoon. (Example: The image of the Man can be incorporated into a medallion or t-shirt with your camp or art project logo.  Or underneath your camp or project logo you can use a phrase such as "Burning Man 2014" – OK!).

Playa-focused gifting projects (such as art or theme camps) with Kickstarter campaigns (or similar fundraising tools) have permission from Burning Man to gift items that incorporate the Man logo, other trademarks or copyrights, or photos from the event into their own designs. (Example: "Donate $15 to our Kickstarter. In appreciation, we will 'gift' you this mug with our art project logo that incorporates the Man symbol" – OK!). 

 

Not OK: SELLING 

 

You cannot sell items with Burning Man's trademarks, copyrights or images from the event. This includes vending online in peer-to-peer resale spaces, such as eBay or Etsy.  This also means that if you create and give away numerous items that incorporate a Burning Man trademark, copyright or image, and after the event you have a number of these left over -- you cannot then offer them for sale (even if you think it's necessary to recoup the costs of making these items). While we sympathize with everyone's need and desire to have sufficient funds to create and gift the art and items that make our culture and event what it is, it would be a slippery slope if such items could be sold simply because they were left over after others were given away – and therefore we have drawn a strict line that says:  Absolutely no sales of any items containing Burning Man's trademarks, copyrights or images from the event. (Examples: Selling a 'Burning Man' logo t-shirt for your theme camp on eBay, or selling earrings with the Man symbol on Etsy - Not OK!)

 

2. Use of the words "Burning Man" or "Black Rock City"

You may use the term "Burning Man" or "Black Rock City" as part of descriptive text for a fundraising event, but do not use these words as the central phrase.  Do not confuse people about who is producing or sponsoring your event.  Use of Burning Man's other trademarks, for example the Burning Man symbol, "Precompression" and "Decompression," may not be used in promoting your event or fundraiser as they are only available for use by official events of Burning Man and the Burning Man Regional Network.  See examples below.  

 

Totally OK: Saying your fundraiser is for your camp "AT BURNING MAN"

 

"A Fundraiser for Camp Forgotten Monsters at Burning Man." Or "A Fundraiser for the Rumification Art Project at Black Rock City." OK!

 

Not OK: Saying or implying "BURNING MAN" is doing it

 

"Burning Man Fundraiser for Camp Forgotten Monsters."  NOT OK. 
"Burning Man Fundraiser for the Rumification Art Project."  NOT OK. 
"Precompression )'( Fundraiser for the Lost and Found Tribe of Tabouli."  NOT OK.

 
3. Use of Photographs from the Event. 

 

Burners are allowed to obtain and use photographs or video at the event for personal use.  This means it is absolutely ok to share the images with friends, post on social networks such as Flickr and Facebook, print copies to share with friends, and use them in informal presentations (subject to a few restrictions, described below). You may also use photographs or footage taken at the event for your theme camp or art project fundraiser as long as the project is intended as a gift for the Burning Man community in Black Rock City.

Also, so you know, if you want to share your images beyond your immediate network or with large audiences, shoot and use photos or video professionally, or display, publish or license them to others, you must register with Burning Man beforehand (you may begin this process by emailing press@burningman.com).  Youthe Press Team, and you must obtain permission from Burning Man before any such use.  This policy is in place simply to protect the privacy and other rights of participants and artists and Burning Man.

 

Totally OK: PERSONAL USE

Posting images from the Burning Man event on your personal, theme camp or art project account on Facebook, your theme camp or art project website, gifting your friend a lovely photo from the event, or using video footage from the playa in your theme camp's Kickstarter video (if the funds will be used specifically for the theme camp's operations in BRC). OK!

 

Not OK: NON-PERSONAL USE

Selling or licensing images or objects including images captured at Burning Man in any manner, filming at the event your band's music video that you will then distribute in any manner, or staging fashion shoots and using images in advertisements or promotions.  NOT OK!

3 Best Practices for Community Fund Management

Best Practices for Community Fund Management

 

Over the past few years, the Regionals team and Meta Committee have observed various groups across the Network taking on projects and events that require high levels of financial planning and accountability.
We've been asked for guidance, and recognize that there's a need for some best practices that can help guide your leadership around spending.

 

Below you'll find some points of reference for handling community funds. This is a living document, and we welcome your suggestions and feedback. 

 

New events and one-time projects:
 
·       Have the group write a budget and agree upon spending procedures together at the beginning of the project.  
·       Set expectations ahead of time with regards to the potential for less income, and resulting inability to fully reimburse or pay full amounts. 
·       Utilize a separate bank account, and use that account for everything project-related (and nothing else).
·       Ensure two leaders have access to the bank account at all times (no solo accounts), and hold each other accountable for all spending and purchases.
·       Require receipts for reimbursement, unconditionally.
·       Share running or post-event high-level financial transparency.
·       Incorporate a system of checks and balances, so no one person is left in the uncomfortable position of being solely responsible for community funds should things not add up for any reason.

 

Larger organizations:

 

·       Keep a budget in Google Drive for all to view, but limit those with editing privileges to the two account signees (or treasurer designees).
·       Provide regular updates from a public budget sheet in Google Drive during project meetings.
·       Distribute high-level public transparency updates during the project, or event cycle.

4 Special Recreation Permits (SRP) from the U.S. Bureau of Land Management (BLM).

 

The Burning Man Event occurs on public land administered by the BLM. Commercial activities (services rendered with the intent of making a profit or financial gain, or delivery of goods and services onto public lands for a fee) are prohibited within the Burning Man Closure area unless specifically contracted by Black Rock City, LLC, and permitted by the BLM.  Any services that are gifts to other members of the community, and for which you have received no payment, are not considered commercial.  If you provide commercial services to participants or theme camps outside of your contract with BRC, please obtain your own SRP from BLM.

Any services of potable water or prepared food are required to furnish a Nevada State Health Certificate. Any fuel services must comply with the FUEL DELIVERY REQUIREMENTS.
